Presidential Notice 13129

Continuation of Emergency With Respect to the Taliban

This notice continues for another year the national emergency declared in Executive Order 13129, which blocks Taliban property and prohibits U.S. trade with Taliban-controlled Afghanistan. The continuation is justified by the Taliban's continued harboring of Osama bin Laden and al-Qaida, who threaten violence against the United States.

  • Blocking of Taliban property continues
  • Prohibition on trade-related transactions with Taliban-controlled territory continues

Near term (90d)

Long term

  • Annual continuation cycle persists unless terminated by President or Congress
  • Potential for further renewals based on national security threat assessment

Risks & tensions

  • Heightened threat environment with explicit reference to al-Qaida attacks against U.S. nationals (notably three months before September 11, 2001)
  • Vague geographic scope—'territory of Afghanistan controlled by the Taliban' creates compliance uncertainty for U.S. persons
  • Perpetual emergency authority without congressional renewal raises separation-of-powers concerns under National Emergencies Act framework
