Executive Order 12943

Further Amendment to Executive Order No. 11755

This executive order makes two technical amendments to Executive Order 11755 regarding federal acquisition of small cost items from prison industries. It updates statutory citations from repealed provisions to current law (sections 3621 and 3622 of title 18) and transfers responsibility from the Attorney General to the Bureau of Prisons. It also exempts micropurchases under $2,500 from the order's requirements.

Long term

Risks & tensions

  • Micropurchase threshold ($2,500 at time) may have changed since 1994; current applicability depends on subsequent statutory adjustments
  • Statutory citation update suggests prior EO had become legally obsolete due to 1984 criminal code reorganization (18 U.S.C. chapter 306 repeal)
  • Minimal policy substance; primarily technical conformity amendment
