Executive Order 13070

The Intelligence Oversight Board, Amendment to Executive Order 12863

This executive order amends EO 12863 to formally establish the Intelligence Oversight Board (IOB) as a standing committee of the President's Foreign Intelligence Advisory Board (PFIAB), limits its membership to no more than four PFIAB members designated by the President, and changes its reporting line so the IOB reports directly to the President rather than through the PFIAB.

Key directives

  • Establish IOB as standing committee of PFIAB
  • Limit IOB to no more than four members designated by President from PFIAB membership
  • Allow PFIAB Chairman to also serve as IOB Chairman or member if so designated
  • Authorize IOB Chairman to employ full-time staff and consultants with PFIAB Chairman concurrence
  • Direct IOB to report to the President (not through PFIAB)

Timeline

Immediate

  • IOB formally designated as standing committee of PFIAB
  • IOB reporting line changed to direct presidential reporting

Near term (90d)

  • Potential reorganization of IOB staffing and consulting arrangements under new Chairman authority

Long term

  • Structural change in intelligence oversight architecture lasting until subsequent reforms

Risks & tensions

  • Text does not specify effective date; assumes immediate upon signing
  • Concurrence requirement between IOB and PFIAB Chairmen on staffing could create friction
  • Vague whether existing IOB members must be re-designated or if this is purely codification of existing practice
  • Reduction to 'no more than four members' may consolidate or reduce previous membership structure
