Executive Order 14031

Advancing Equity, Justice, and Opportunity for Asian Americans, Native Hawaiians, and Pacific Islanders

This executive order establishes a new President's Advisory Commission and White House Initiative on Asian Americans, Native Hawaiians, and Pacific Islanders (AA and NHPI) within the Department of Health and Human Services. It creates a whole-of-government framework to advance equity, justice, and opportunity for these communities through interagency coordination, data disaggregation, language access, hate crimes tracking, and annual reporting on measurable progress across federal agencies.

Impact dates

  1. Agency plans due to Co-Chairs and Executive Director (frequency set by Executive Director)

  2. Progress reports on agency plans due to Co-Chairs and Executive Director (regular basis established by Co-Chairs and Executive Director)

  3. Commission termination unless sooner renewed by President

  4. Annual government-wide interagency plan due to President

Who is ordered

Timeline

Immediate

  • Establishment of Commission and Initiative within HHS
  • Supersession of four prior executive orders (13125, 13339, 13515, 13872)
  • Designation of HHS Secretary as Co-Chair of both bodies

Near term (90d)

  • Agency plan development and submission to Co-Chairs and Executive Director
  • Executive Director establishment of reporting frequency for agency plans
  • Coordination with existing Regional Network of federal officials

Long term

  • Annual government-wide interagency plan submission to President
  • Ongoing progress assessments on agency plans
  • Commission terminates May 28, 2023 unless renewed
  • Sustained interagency coordination on 14 policy priority areas

Risks & tensions

  • Implementation dependent on 'existing appropriations' and 'subject to availability of appropriations' — funding constraints may limit effectiveness
  • Vague timing: agency plan deadlines and reporting frequency delegated to Executive Director and Co-Chairs rather than fixed in order
  • Commission's 2-year sunset creates uncertainty about continuity of advisory function
  • No enforcement mechanism for agency non-compliance with plans or reporting
  • Data disaggregation goals require coordination with separate Interagency Working Group on Equitable Data established by EO 13985, creating interdependency
  • Order explicitly disclaims creating enforceable rights, limiting legal recourse for affected communities
