Executive Order 14341

Prosecuting Burning of the American Flag

This executive order directs the Attorney General to prioritize prosecution of American flag desecration under existing content-neutral laws (violent crimes, hate crimes, property crimes, disorderly conduct) and directs the Secretaries of State, Homeland Security, and the Attorney General to deny or revoke visas, immigration benefits, and pursue removal of foreign nationals who engage in flag desecration under circumstances permitted by federal immigration law. The order explicitly acknowledges First Amendment limits from Texas v. Johnson but seeks to maximize enforcement within those boundaries and pursue litigation to clarify First Amendment exceptions.

Key directives

  • Attorney General shall prioritize enforcement of criminal and civil laws against flag desecration that violates content-neutral laws
  • Agencies shall refer state/local law violations to appropriate authorities
  • Attorney General shall vigorously prosecute and may pursue litigation to clarify First Amendment exceptions
  • Secretary of State, Attorney General, and Secretary of Homeland Security shall deny, prohibit, terminate, or revoke visas, residence permits, naturalization proceedings, and other immigration benefits, or seek removal of foreign nationals engaged in flag-desecration activity

Who is ordered

  • DHS/State/DOJ instructed to deny/revoke immigration benefits for foreign nationals involved in flag desecration

Long term

Risks & tensions

  • First Amendment tension: order acknowledges Texas v. Johnson but pushes boundary of 'content-neutral' enforcement and 'fighting words' exception
  • Risk of selective prosecution claims if flag desecration enforcement disproportionately targets political opponents or specific groups
  • Immigration consequences for protected speech could face constitutional challenge under First and Fifth Amendment due process
  • Vague scope of 'appropriate determination' for immigration remedies creates discretionary uncertainty
  • Potential conflict with state/local priorities if federal agencies pressure referrals for minor offenses
