To Further Facilitate Positive Adjustment to Competition From Imports of Certain Crystalline Silicon Photovoltaic Cells (Whether or Not Partially or Fully Assembled Into Other Products)
This proclamation expands the tariff-rate quota (TRQ) on imported crystalline silicon photovoltaic (CSPV) cells from 5 GW to 12.5 GW annually, modifying existing safeguard measures first imposed in 2018 and extended in 2022. The change responds to a domestic industry petition noting that increased U.S. module production requires more imported cells than the previous quota allowed.
Adjusting Imports of Aluminum Into the United States
This proclamation reinstates Section 232 tariffs on aluminum imports from Mexico by imposing a country of smelt and country of most recent cast requirement. Aluminum products from Mexico containing primary aluminum smelted or cast in China, Russia, Belarus, or Iran face higher duties, while eligible Mexican aluminum must be accompanied by a certificate of analysis to enter duty-free.
To Further Facilitate Positive Adjustment to Competition From Imports of Certain Crystalline Silicon Photovoltaic Cells (Whether or Not Partially or Fully Assembled Into Other Products)
This proclamation revokes the exclusion of bifacial solar panels from Section 201 safeguard tariffs on crystalline silicon photovoltaic (CSPV) cells and modules, subjecting them to duties originally imposed in 2018 and extended in 2022. The action takes effect June 26, 2024, with limited exemptions for bifacial panels under pre-existing contracts executed before May 17, 2024, that are imported within 90 days of the effective date.
Adjusting Imports of Aluminum Into the United States
This proclamation imposes a 200 percent tariff on Russian aluminum and derivative aluminum articles, effective March 10, 2023 for products of Russia and April 10, 2023 for articles containing Russian-smelted or Russian-cast primary aluminum. It amends prior proclamations 9704 and 9980, adds smelt and cast reporting requirements for importers, and removes eligibility for General Approved Exclusions and in-quota treatment for covered Russian aluminum imports.
